    reading articles is a good thing.

     Bungie gave the go-ahead even before development began.  I saw that your mod got scrapped, and that sucks.  But Ensemble is in good waters.

     You may know me, you may not but lemme just tell you a small story.

    I was the leader of the Halo: Retreat and Retaliation mod for DoW, we also had other sister project such as the HaloGen mod for CnC Generals. One day Microsoft sent the old "Cease and Desist" order to HaloGen after 3 years of hard work from that team, we all took inspiration from this mod, and they were just about to release when they recieved the order.

    Now our mods we non-profit, fan-based mods which we tried to pay tribute to the Halo universe. Now before you guys say something like "ha ha, well you should have expected this" attempts were made by both teams to contact both Microsoft and Bungie. I personally made 3 attempts. We never recieved replys from either. So we decided to continue. Now after a few years our work is now wasted. I have even recently contacted MS's IP department and they gave me the worst and most stupid email reply ever. (If you wanna see it, visit our forum)

    So basically i just wanted to give a warning, if Ensemble Studios is acting without either company backing them, then they will be screwed. If you havent got the backing then stop now. If you have then by all means continue.

    Esemble Studios and Bungie are both working on it.  A few Bungie employees were helping ES do a few things, atleast thats what it sounds like in one of the Bungie Weekly Updates. 

    Sorry about your mod project being shut down after all that work.  Bungie does have a right to protect their IP though.

    When you started making it did you send any contact to Bungie for acceptance to make it?

    I was really looking forward to your mod... pity it got shut down. Can you send it to me? Big Smile DoW or Gen.. doesn't matter.

    My current opinion... both Microsoft & Bungie need to lighten up. If fans create something of a game, usually this is a good thing. I dunno, I would have loved to see your mod.

     Yes we did send messages to Bungie, we even had threads on their forum for 2 years.

    There has been a lot of misinformation about this going around. I can't see why, as the lead for Halogen, Dispraiser, has been interviewed on several different sites and has given a complete and exhaustive account of events. It seems that other people are somehow motivated to twist the story into something else.

     Halogen was not issued a C&D. They were informed by Bungie that one would be forthcoming. Bungie attempted to intercede on Halogen's behalf with Microsoft to no avail, as they do not have final say over such issues. Bungie urged the Halogen team to continue working on their mod as a work of original intellectual property, as much of the team's work was original. They are doing so.

    Halogen was not a mod of Halo. It was a mod of C&C Generals. The makers of C&C Generals, as far as I know, had no objection. If Halogen had been a modification of Halo Custom Edition to make it more like C&C Generals, I doubt Microsoft would have objected. The makers of C&C Generals, however, very likely would have! 

    User created content for the Halo game engine adds value to Halo as a platform. It gives people a reason to keep playing the game, and it reinforces the community around the game.

    A modification for another game, based on designs and artwork from Halo, characters from Halo, and story elements from Halo, does very little for the portion of the Halo community which Microsoft is interested in fostering: that is, gamers who bought and own legitimate copies of Halo games.

    While it may be that there is overlap between purchasers of Halo and C&C Generals, there is no way to know that. In essence, the project is capitalizing on intellectual property Bungie developed, with absolutely no direct benefit to Bungie or Microsoft, and very little (if any) indirect benefit.

    Once you throw in the idea of a separately developed Halo themed RTS game being developed internally, which Microsoft is also intending to use to promote the Xbox 360 as a platform for fans of RTS games, you have to recognize at least the potential for actual harm to the Halo franchise.

    Bungie didn't want Halogen to be shut down, but it had to acknowledge Microsoft's legal right to do so.

It is a shame that it was done so late, but so much of the work they did was not directly related to Halo that it will not go to waste. They knew, the entire three years they worked on the project, that this might happen.

    What is becoming more of a shame in this is how people only tangentially related to Halo or Halogen feel the need to modify the story to suit their own particular ends; to suggest that Bungie was responsible for the closure (which they were not) to suggest that Bungie is somehow obligated to respond positively to every fan group request for approval to make Halo mods for other games (they are not), and to suggest that Bungie gave prior approval for such mods to the Halogen group or any other such group (they have not). To my knowledge, the only fan group creating contractually authorized derivative content from the Halo universe is Rooster Teeth with Red vs Blue, which I think is unlikely to be competing with any Microsoft product in the near future unless they open a machinima department.

    I know its so called "copy right infringement" but i dont think it is really.. its just microsoft scared that a simple mod is going to destroy there precius bank.

    I know they don't want competition but if Halogen was for the PC and Halo Wars for 360 i don't see much of a problem.  i honestly don't think people are going to buy 360's just to play Halo Wars anyway so they could play Halogen on their PC

    Honestly, it should be allowed to carry on, because it isnt going to draw people away from it.. its on the PC, it will give PC gamers a chance to play a HALO rts. I dont think it would effect microsoft much, but they have spoken and so shall it be..

    how do you now see it as a copyright infringment, they had the word halo right in the name, and all the characters looks were taken directly out of halo.

    not only that, this mod has sent an Email to Microsoft and asking whether the mod should stop. but Microsoft's reply was this

    that just proves that Micro$**t just don't care about their customer/supporter's Email. at least they should employ a more able person who can read.

    Halogen was being worked on for three years not 1.

     

    Second obviously this is the reason halogen had to get shut down. I mean honestly they were shut down just two weeks before this was announced.

    Competition? Halogen wasn't a competing game. It was a simple little mod. It wasn't even for the same hardware. Competition was imagined here.

    yeah, but no one would have bought halo wars & a 360 (in case thoy didnt had one) if they could have bought the mod (of even worse, free download)

    now MS is the only kid in the blobk with the RTS, and kinda applys the rule of: want it? buy me first a 360

    400$ for the 360 + 60$ for the 360 game, or the usual release date price of 50$ for the pc game?

    the cease and desist order doesn't mean that they did anything illegal.  it was a simple request that the mod developers stop working on the project.

    i think ES should get some of those guys to help with this project.  they have had 3 years to sit and think about halo as an rts, even if its just to see how the game "feels."  those guys have had to think about unit size ratios, the balance of units, how the units interact with each other, etc.

    would be a shame to let fans like that get slapped, because of $$.
